Social Security Fairness Act: WEP repeal and your Indian pension

  • What to do about it
  • Count your credits before anything else

The Social Security Fairness Act, signed January 5, 2025, repealed the windfall elimination provision (WEP), so a pension from Indian employment no longer cuts your US Social Security for any month from January 2024. It doesn't touch the 40-credit minimum, which decides whether you get a US benefit at all.

Key Takeaway

The repeal is real, and it helps a narrower group of NRIs than you might expect.

  • WEP no longer reduces any US benefit for months from January 2024.
  • Past WEP cuts never exceeded half your monthly pension.
  • Late filers generally get only six months of back pay.
  • You still need 40 credits, roughly ten years of US work.
  • India has no totalization agreement with the US.

What the Social Security Fairness Act changed

The Act (Public Law 118-273) repealed two rules together: WEP and the Government Pension Offset. December 2023 was the last month either one applied. SSA's Fairness Act page puts the line at benefits payable for January 2024 and later.

What the windfall elimination provision did to an Indian pension

If you drew a pension from work that wasn't covered by US Social Security, WEP cut your own US retirement or disability benefit. SSA says these pensions typically come from state and local governments or non-US employers, and a pension earned in India is one from a non-US employer.

How the IRS treats EPF, PPF and NPS is a separate question from this one.

The cut worked by shrinking the first 90% factor in your benefit formula, down to 40% if you had 20 or fewer years of US coverage. It was capped at half your monthly pension, so a small pension meant a small cut. The largest reduction in 2023 was $557.50 a month.

What the repeal covers, and who gets paid

SSA began adjusting monthly payments on February 25, 2025. By July 7, 2025 it had sent more than 3.1 million back payments totaling $17 billion, and the Congressional Research Service puts the average at $7,208. Back pay reaches to January 2024.

Filing late changes the math. If you applied after January 5, 2025, the usual six-month retroactivity limit generally still applies, so your back pay may not reach January 2024.

What the repeal does not fix

The 40-credit rule still decides everything

The Act removes a reduction. It doesn't create a benefit. You earn at most four credits a year, so 40 credits means ten years of covered work, and in 2026 one credit takes $1,890 of covered earnings ($7,560 earns all four).

Worked example: Rahul worked nine years in the US on an H-1B and moved back to Pune.

  • Years of covered US work: 9
  • Credits at four a year: 36
  • Credits needed: 40
  • Shortfall: 4 credits, so no US retirement benefit and no change from the repeal
  • What closes the gap: one more year with at least $7,560 of covered earnings (the 2026 figure)

If you may end up without a US benefit, size the corpus you need to retire in India first.

I'd treat the credit count as the first number in any return-to-India retirement plan, ahead of anything the Act changed.

There is still no totalization agreement with India

A totalization agreement lets SSA combine your US credits with credits from the other country's system, so you can qualify for a partial benefit. SSA lists 31 countries with agreements, and India isn't one. Your Indian working years can't help you reach 40.

Who this applies to

Your situation decides whether the repeal means anything for you:

  • You have 40 or more credits and a pension from Indian employment: any WEP reduction is gone for January 2024 onward.
  • You have 40 or more credits and no Indian pension: the Act changes nothing for your own benefit.
  • You have fewer than 40 credits: there's no US retirement benefit to repair.
  • You draw a spouse's or survivor's benefit on someone else's record and have a pension from work that wasn't covered, typically state or local government or a non-US employer: the Government Pension Offset is gone for you too.

The repeal changes the size of a benefit, not where it's taxed. Under Article 20(2) of the US-India tax treaty, US Social Security is taxable only in the US.

What to do about it

  1. Sign in to your my Social Security account at ssa.gov/myaccount and read your earnings record year by year.
  2. Count your credits, at most four per year, against the 40 you need.
  3. If a year is missing or low, file Form SSA-7008 with W-2s or pay records. SSA's normal correction window runs three years, three months and 15 days after the year the wages were paid, with narrower exceptions after that.
  4. If WEP was cutting a benefit you already get, confirm SSA has your current bank details, because back pay goes to the account on file.
  5. If you never filed because you assumed a reduction would wipe out your benefit, file now. Every month of delay can cost you back pay.

The one decision that needs a professional is whether to finish a tenth year to reach 40 credits, because it trades a year of your career plans against a lifetime benefit. Retirement planning as an NRI covers the other side of that trade.

Count your credits before anything else

Pull your earnings record this week, because the 40-credit count matters more than the repeal. If you're one year short and your visa and job allow it, I'd look hard at finishing that year before you move. InvestMates can check your record and your return-to-India plan together.

Frequently asked questions

Who qualifies for the Social Security Fairness Act?

The Act applies to anyone whose Social Security benefit was reduced by WEP or the Government Pension Offset, with no separate qualification test. You still have to qualify for a benefit in the first place, which takes 40 credits for retirement. If you never filed, you file as usual.

Who is eligible for retroactive Social Security benefits?

Anyone already getting a benefit reduced by WEP or the Government Pension Offset can receive back pay to January 2024. People who filed after January 5, 2025 generally face the usual six-month limit. Once paid, the money follows the usual rules on how India treats Social Security.

Is WEP still used today?

No. The last month WEP applied was December 2023. It still governs months before January 2024, so SSA can ask for pension details to check payments for those months.

How do I fix a missing year on my Social Security earnings record?

File Form SSA-7008 with W-2s or pay records. SSA's normal correction window is three years, three months and 15 days after the year the wages were paid. The Social Security eligibility rules explain how each corrected year adds credits.

What did the Government Pension Offset do, and does the repeal cover it?

The Government Pension Offset cut spousal and survivor benefits by two-thirds of the monthly pension from work not covered by Social Security, typically state or local government or a non-US employer. The Act repealed it for January 2024 onward. It matters only if you're a spouse or survivor drawing on someone else's record.
